Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the PEN Education website (www.peneducation.com.au) and our tutoring services. By accessing our website or enrolling in our programs, you agree to be bound by these Terms.

1. About Us

PEN Education Pty Ltd ("PEN Education", "we", "us") operates tutoring centres in New South Wales, Australia. Our registered address is Level 1, Top Ryde City Shopping Centre, Ryde NSW 2112.

2. Services

PEN Education provides in-person tutoring programs, diagnostic assessments, homework support, and related educational services for primary and secondary school students. Our programs include but are not limited to: Weekly Program, OC Prep, Selective Prep, Writing Master, Scholarship Elite, Transfer to Selective, PEN Clinic, and Holiday Intensive programs.

3. Enrolment

3.1 Eligibility

Students must be enrolled by a parent or legal guardian. By enrolling your child, you confirm that you have the authority to do so and that the information provided is accurate.

3.2 Diagnostic Trial

We offer a complimentary diagnostic trial for new students. The trial includes four adaptive assessments and two reports. There is no obligation to enrol after the trial.

3.3 Minimum Enrolment Period

Our standard programs require a minimum enrolment of 10 weeks. Early withdrawal within the minimum period may result in forfeiture of any promotional discounts applied at enrolment.

4. Fees & Payment

4.1 Tuition Fees

Fees are charged per session or per term as outlined at the time of enrolment. All fees are in Australian dollars and inclusive of GST where applicable.

4.2 Payment Terms

Payment is due prior to the commencement of each term or as agreed upon enrolment. We accept bank transfer and major credit/debit cards. Late payments may result in suspension of services.

4.3 Refunds

Fees are generally non-refundable. Refunds may be considered on a case-by-case basis for documented medical or hardship reasons, at PEN Education's sole discretion.

5. Attendance & Cancellation

5.1 Attendance

Regular attendance is essential for academic progress. Parents/guardians are responsible for ensuring their child attends scheduled sessions.

5.2 Missed Classes

There are no refunds or credits for missed classes. In extenuating circumstances, we may offer a make-up class at our discretion, subject to availability.

5.3 Withdrawal

To withdraw from a program, written notice of at least 2 weeks is required. Notice should be sent to info@peneducation.com.au.

6. Student Conduct

Students are expected to behave respectfully toward teachers, staff, and other students. PEN Education reserves the right to suspend or terminate enrolment for persistent disruptive behaviour, after reasonable communication with the parent/guardian.

7. Intellectual Property

All content on our website, including text, graphics, logos, software, diagnostic tools, curriculum materials, and reports, is the property of PEN Education and is protected by Australian copyright law. You may not reproduce, distribute, or modify any content without our prior written consent.

8. Website Use

8.1 Accuracy

We make reasonable efforts to ensure the information on our website is accurate and up to date. However, we do not guarantee that all content is error-free. Program availability, schedules, and pricing may change without notice.

8.2 Third-Party Links

Our website may contain links to external websites. We are not responsible for the content or practices of those websites.

8.3 Chatbot

Our website includes an AI-powered chatbot to assist with general enquiries. Responses are generated automatically and may not always be accurate. The chatbot does not constitute professional advice. For specific enrolment or academic queries, please contact us directly.

9. Limitation of Liability

To the maximum extent permitted by law, PEN Education is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim is limited to the fees paid for the relevant program.

Nothing in these Terms excludes or limits consumer guarantees under the Australian Consumer Law.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in that policy.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
